TIGTA Finds Flaws in IRS's Tax-Exempt Entities Anti-Fraud Program
The Treasury Inspector General for Tax Administration (TIGTA) has released a report entitled “A Corporate Approach Is Needed to Provide for a More Effective Tax-Exempt Fraud Program” which recommends specific changes to strengthen the effectiveness of the Internal Revenue Service (IRS) Tax Exempt/Government Entities Division’s Anti-Fraud Program.

Court Enforces Christian Conciliation Provision in Teacher’s Contract
A Federal District Court in Indiana ruled that a school teacher agreement requiring disputes to be submitted to Christian conciliation did not constitute a substantive waiver of her federal rights under the Age Discrimination in Employment Act (ADEA) or the Americans with Disabilities Act (ADA).

CCBE Comments on Possible European Foundation Statute
The Council of Bar and Law Societies of Europe (CCBE) recently submitted comments to the European Commission regarding the possible establishment of a European Foundation Statute that would help overcome some of the legal and tax-related obstacles that currently exist in cross-border nonprofit operations and activities.

Perlman & Perlman Spotlight
Seth Perlman - will be co-chairing a seminar titled “Financial and Reporting Issues for Nonprofits – 2010” to be presented at the  Practising Law Institute in New York City on March 30, 2010.

Seth Perlman will be giving a presentation on “The Law of Fundraising” at the Practising Law Institute Advising Nonprofits seminar on February 3, 2010 in New York City.

Allen Bromberger spoke at the New York City Bar Association on November 2, in New York City. His topic was “Proposal to Reform New York State Nonprofit Corporation Law.”

Cliff Perlman attended the National Association of Attorneys General/National Association of State Charity Officials (NAAG/NASCO) annual conference in Austin, Texas on October 19, to meet with regulators throughout the country regarding State Regulation of Charitable Activities.

Cliff Perlman and Karen Wu gave a presentation on Legal Issues Facing Development Offices at the 2009 National Catholic Development Conference (NCDC) Conference and Exposition on September 21 in Arlington, Virginia.

EIF Mobilizes the Entertainment Industry to Promote Volunteerism

The Entertainment Industry Foundation (‘EIF”) brought together the four major broadcast networks – ABC, CBS, FOX and NBC –for an unprecedented week of television, which took place on October 19 -25, 2009 as part of EIF’s national initiative, iParticipate, to promote public service and volunteering.

EIF mobilized the entire entertainment community around the ground-breaking iParticipate campaign, which promotes a new way of thinking about service and seeks to persuade millions more Americans to volunteer regularly. As a centerpiece, the major broadcast networks and others spotlighted service through scripted programming, segments and public service announcements with inspirational messages and storylines about volunteerism. More than 100 shows signed up to participate. As result of EIF’s efforts, hundreds of thousands of potential volunteers visited the iParticipate website to find out about public service opportunities in their community. The initiative is a multi-year effort and will continue for the foreseeable future.
